Are Invoices to be paid in SGD?

All our invoices corresponding to purchases delivered to the Singapore in SGD, and can be paid by PayPal or bank transfer in the same currency.

Any other currencies are served as reference only.

Do your prices include taxes and duties?

Yes, the prices displayed on the website are inclusive of GST and excise duties, excepting our en primeur wines, which are displayed in-bond ex-GST.

As we are dedicated to private individuals, we declare and settle all local taxes and duties on your behalf. All you need to do is order, pay and then sign the delivery slip on arrival of your wine, of course after having checked its integrity.

What are your shipment and delivery costs?

Delivery fee of SGD 20.00 applies for order below SGD 1000.00; for non-premium wine only. Should you wish to be delivered to more than one address in Singapore, an additional delivery fee will apply.

For Premium wine and Malts purchase, our shipping agent will quote once the shipping your address is finalized.

Do you require a signature on delivery?

We require a signature upon delivery for insurance reasons. Upon reception of the wines, it is the responsibility of the addressee to check the state of the goods and to note any reserve concerning breakage, damage or missing goods on the delivery slip. If the delivery slip does not indicate any reserve, Wine and Malt is not obligated to provide compensation to the recipient for this order. The signatory must be over 18 years of age.

1.1 About Wine and Malt

  1. Your purchase of goods from www.winenmalt.com (“website”) is subject to these Terms and Conditions of Sale, The Terms of Use, the Returns Policy, the Cookies and Privacy Statement [1] and any Catalogue Terms (collectively referred to herein as “Terms”). If you do not accept these Terms, you must refrain from using this website or making a purchase from this website.
  2. www.winenmalt.com is a website operated by Vision Zenith Corporation Pte Ltd (“us”, “our”, “we”, “Wine and Malt”). We are a private limited liability company registered in Singapore and have our registered office at 7030 Ang Mo Kio Ave5 #02-52 Singapore 569880.

  3. The goods and services described in this website are available from Wine and Malt only.

  4. You and "Wine and Malt" may enter into a sale contract for the sale and supply of goods or services described in this website, by you making an offer to Wine and Malt via the website, to purchase the goods and services at the specified price, subject to these Terms.

By continuing to use this website after such publication, you agree to be bound by these Sales Terms as revised. 1.3 Guests and Registered Users

  1. You may access and/or use the website as a guest or as a member and any other category of users.
  2. To become a member of the website, you must provide your name and address, telephone number, a valid email address and nominate a password. If you do not provide accurate and complete details, we may not be able to activate your membership or supply goods or services to you. You agree to keep your membership details current at all times by accessing your account via the website or by contacting our Admin at admin@winenmalt.com.
  3. You will receive an email from us as soon as practicable after you create your membership account.
  4. We only permit one registration per email address.
  5. You must not use another member’s account without permission.
  6. You must keep your password secure as you are responsible for any activity on your account. You agree to notify us immediately if you become aware of any security breach or any unauthorised use of your password or account.
  7. If you forget your password you may click on the relevant link located on the website and we will email you a new password, or you may contact our Admin at admin@winenmalt.com.
  8. We reserve the right to terminate a member’s account without notice for any reason whatsoever including without limitation, if you have breached or we suspect you have breached these Terms.

1.4 Legal Capacity

  1. You must be eighteen (18) years of age or over to register as a member of the website or purchase goods or services from the website.
  2. Any Order and/or purchase made by you using this website is an acknowledgement by you that:
  • You are over the age of eighteen (18) years
  • You accept these Terms
  • You agree that you have entered into a legal contract with Wine and Malt in relation to these Terms, together with your Order, constitute the entire agreement between you and Wine and Malt for the supply of goods or services

1.5 Orders

  1. We recommend you carefully preview any proposed Orders before adding them to your shopping cart and proceeding with your Order.
  2. Once an Order has been accepted by Wine and Malt, no cancellation of that Order is valid unless you receive our written communication permitting the cancelled Order.
  3. Representations of goods or services for sale made by Wine and Malt via the website do not constitute an offer to sell but an invitation to treat.
  4. You and Wine and Malt may enter into a contract for the sale and supply of goods or services by you making an offer via the website to purchase goods at the price advertised on the website by:
  • Placing an Order manually after accepting an electronic enquiry for accepting the goods or services using the website. (For premium) will also constitute a contract for sale.
  • You confirm the Order details in accordance with the procedure on the website.
  • You making payment in full (plus any applicable delivery and handling charges) when receiving your parcel.

  • The acceptance of that offer by Wine and Malt
  • When entering into a sales contract via the website, you enter through immediate payment or via enquiry. you will be taken to have communicated your offer to purchase the good(s) or services only when:
    • any and all requirements set out in these Terms have been met.
    • the electronic instruction containing the offer from you enters and is recorded in our database.
  • a record is created and stored in our database.
  • Wine and Malt receives in its account full payment from you for the goods or services (including any applicable delivery and handling charges) and confirmation of that payment is received by our database.

EN PRIMEUR

  • All En Primeur prices are quoted in Singapore Dollars exclusive of any Goods and Services Tax (GST). Prices are offered lying ex-cellar in Bordeaux.
  • Prices do not include shipping, freight insurance or government duties.
  • All prices quoted are subjected to indicated validity periods and are subjected to change without prior notice.
  • Minimum Purchases
    The minimum purchase is 3 bottles (of the same label) of any 750ml bottle. The total minimum purchase for your entire order must be at least 12 bottles for 750ml bottles or 24 bottles for 375ml bottles.
  • Order Confirmation
    All En Primeur offers are subjected to remaining unsold and subjected to our written order confirmation.
  • Shipping
    The wines will be shipped up to 2-3 years later when the bottled wines are released. Shipping, freight insurance and related tax and duty charges will be invoiced to you at that time.
    The indicative additional cost is estimated at $20.00 per bottle.
    Goods and Services Tax at the prevailing rates will also be levied on the imported value of the wines brought into Singapore.
  • Payment
    Payment shall be 100% of the total amount payable within 7 days of our confirmation of your order. If the order is not paid after 7 days, we will deem that you are not interested in the offer and the order will be cancelled.
    All payment made are not refundable and Wine and Malt reserves the right to cancel unpaid orders at any time after due payment date.

1.6 You acknowledge that:

  1. the transmission of your offer or the confirmation of any payment, made through an electronic instruction may not be received by Wine and Malt for reasons beyond either parties' reasonable control including but not limited to, electronic failure, mechanical, software, computer, or telecommunications failure, or the omission or failure of third party website providers or systems.
  2. to the fullest extent permitted by law, Wine and Malt is not liable to you in any way for any loss or damage of any kind, however caused, arising directly or indirectly in connection with the transmission of an electronic instruction through the website, or any failure to receive an electronic instruction for whatever reason.
  3. Wine and Malt may act on and process all completed electronic instructions transmitted or issued through the website or via other agreed form of communication, such as email without further consent from or reference to you.
  4. Wine and Malt may treat an electronic instruction as authentic and is under no obligation to investigate the authenticity or authority of persons issuing or transmitting such electronic instructions, or to verify the accuracy and completeness of such electronic instructions.
  • You will receive an email from Wine and Malt as soon as practicable after you have confirmed your Order and made payment. If you have any questions regarding your Order you may contact the Admin at admin@winenmalt.com. Please note this email does not constitute acceptance of your Order by us but merely confirms our receipt of your Order.
  • If your Order is not accepted by Wine and Malt, Wine and Malt will notify you by telephone or email and arrange for a full refund of any payment made by you to be processed.
  • Wine and Malt may, in its sole and absolute discretion, accept or reject any offer made by you for any reason (or no reason), including an error in the advertised price for, or description of, goods or services on the website, or an error of any kind in or relating to your Order.
  • Any representations made at any time about stock availability are accurate to the last known stock level and are subject to change. If Wine and Malt cannot supply particular goods, Wine and Malt will notify you by telephone or email as soon as possible.
  • Subject to clause 6, Wine and Malt will be deemed to have accepted your Order on the first to occur of issue to you of a tax invoice for the sale and the fulfilment of your Order.
  • If you have any query about the progress of your Order, please contact the Admin at admin@winenmalt.com. Please have your Order number handy as shown on the email confirmation.

1.7 Price

  1. Prices shown are in Singapore dollars and include GST where applicable. Prices shown in other currencies is only for reference purposes. Prices may not include delivery and handling charges. Prices are valid until amended or removed from the website and are subject to change at any time.
  2. Images of goods shown without any advertised price beside that image are not offered for sale. Should state the leagal hierarchy offerred product name or picture (should be text)
  3. Unless otherwise stated, accessories shown in any image of goods are not included in the price.
  4. We reserve the right to correct any errors published on the website at any time.

1.8 Payment

  1. All payments must be made in full prior to delivery, including any applicable delivery or handling charges.
  2. All cash on receipt payments must be made in full when receiving parcel, including any applicable delivery or handling charges.
  3. Payments must be made via the PayPal secure payment gateway and T/T (premium wine/malt) facilities accessible via the website and will be subject to any additional terms and conditions of these providers.
  4. To the extent permitted by law, we will not be responsible for any damages or consequential losses (whether direct or indirect) suffered by you where a credit card or payment account is fraudulently used or is used in an unauthorised manner.
  5. If there is a problem with your payment (for example, if your credit card transaction is declined), we may contact you to make alternative payment arrangements. You will be liable for all debt collection costs where you fail to make payment for any order when payment is due.

1.9 Supply and Delivery

  1. Subject to you complying with these Terms and acceptance of your Order by Wine and Malt, Wine and Malt will sell and supply the goods or services to you as shown on your Order confirmation.
  2. If the goods that you have ordered are in stock Wine and Malt will endeavour to dispatch orders within two (2) to five (5) business days (Monday to Friday).
  3. Goods may not be available for immediate delivery. Wine and Malt will advise the users on the possible delivery dates.
  4. When you complete your Order you will be prompted to select to have the Order delivered to an address specified by you
  5. if Wine and Malt gives you notice that it will be unable to deliver your Order within one (1) to five (5) business days of receipt of your Order, due to lack of stock, you may cancel your Order without charge, and Wine and Malt will arrange for a full refund of any payment made by you to be processed.
  6. Delivery dates are estimates only and we are unable to accept any liability for failure to deliver the goods within the specified time resulting from shipment/delivery delays from our suppliers.
  7. If there is no one available to accept delivery on the pre-arranged delivery date, you will be charged for storage, transport and re-delivery costs
  8. Should you arrange your own delivery or collection then the goods become your responsibility upon collection from Wine and Malt
  9. We cannot accept responsibility for delivery failures or delays by our third party delivery contractor.

1.10 Delivery by Post or Courier

  1. The terms of this clause apply where you select to have your goods delivered to a specified address.
  2. The delivery address must be an address within Singapore and cannot be a freight forwarding location. Deliveries cannot be made to PO Boxes and the following areas: Jurong Island, Tuas Link, Changi Cargo, Country Clubs, Army Camps, Seletar Aerospace, Off-shore Islands such as Pulau Ubin, Turf Club Avenue, Resorts World at Sentosa, Singapore Prison Quarters, Airbase sites, SATS Inflight Catering Centre 1, ST Kinetics, Shipyards Powergrid.
  3. On acceptance of your Order by Wine and Malt, your Order will be dispatched to your specified delivery address generally within dispatch orders within two (2) to five (5) business days, subjected to the other provisions of these Terms.
  4. If you Order large or bulky items, Wine and Malt will contact you by telephone or email to arrange with you a suitable time for delivery.
  5. You will be required to be available in person to accept delivery of your Order.
  6. If you wish to change the delivery date or delivery address you must contact the Admin at admin@winenmalt.com at least 48 hours prior to the dispatch of your Order.
  7. Wine and Malt will use its reasonable endeavours to deliver your Order within any stated timeframes for dispatch, however Wine and Malt does not warrant that these timeframes will always be met, as many factors may affect these timeframes.
  8. You must advise at the time you place your Order via the website or later when you discuss delivery with Wine and Malt, of any difficulties that may be involved in the delivery (such as stairs or narrow entries). If you do not state the situation correctly and on arrival the delivery contractor deems it to be a difficult location you will be liable for any extra charges including redelivery fees and the cost of an extra person to assist.
  9. Wine and Malt cannot and will not accept responsibility for delivery failures or delays by our third party delivery contractor.
  10. You are required to inspect your goods when you take delivery of them. You will be required to note any damage on the delivery documentation which is presented to you by the carrier for signature. In all other cases you will be required to notify us in writing of any damage on delivery or shortages within seven (7) days of delivery. We will not be liable for any damage on delivery to any of the goods unless we are notified within the time period specified above.

1.11 Title and risk in goods

Title and risk in goods pass to you on delivery or collection and after full payment has been received by Wine and Malt.

1.12 Payment and credit card fraud

To the fullest extent permitted by law, Wine and Malt and its related entities will not be responsible for any damages or consequential losses of any kind (whether direct or indirect) suffered by a user where a credit/debit card, PayPal account or other payment method is fraudulently used or is used in an unauthorised or improper manner.

1.13 Disclaimer and Indemnity

  1. To the fullest extent permitted by law (and without limitation to any other provision of these Terms), Wine and Malt, and each of its related entities, exclude all liability to you or anyone else for any and all loss or damage of any kind (however caused or arising) relating in any way to the website (or any goods or services purchased on the website) including, but not limited to, loss or damage you might suffer as a result of:
    1. errors, mistakes or inaccuracies on the website.
    2. you acting, or failing to act, on any information contained on or referred to on the website and/or any linked website.
    3. personal injury or property damage of any kind resulting from your access or use of the website.
    4. any unauthorised access to or use of the websites secure servers.
    5. any interruption or cessation of transmission to or from the website.
    6. any bugs, viruses, trojan horses or other harmful code or communications which may be transmitted to or through the website by any third party.
    7. the quality or fitness for any purpose of any linked sites.
  2. Without limitation to the foregoing, except as expressly provided in these Terms and to the fullest extent allowed by the law, Wine and Malt and its third parties will not be liable for any direct, indirect, special, incidental or consequential damages arising out of your access to or use of the website or any goods or services purchased on it.
  3. Except as expressly stated in these Terms, we do not give any representation, warranties or undertakings in relation to the goods or services on the website. Any representation, condition or warranty which might be incorporated into these Terms by statute, common law, the law of equity or otherwise is excluded to the fullest extent permitted by law. In particular, we will not be responsible for ensuring that any goods or services are suitable for your purposes
  4. You will at all times indemnify, and keep indemnified, Wine and Malt, and each of its related entities, including their directors, officers, employees and agents from and against any loss (including reasonable legal costs and expenses on a full indemnity basis) or liability incurred or suffered by you or by any of them arising from any claim, demand, suit, action or proceeding by any person against you or them where such loss or liability arose out of, in connection with or in respect of your conduct or any breach of these Terms

1.15 Damaged or Faulty Goods

  1. If any goods ordered by you arrives damaged, you may have: rights under our Returns Policy. to have the damaged goods replaced
  2. If your Order arrives damaged, please contact our Admin at admin@winenmalt.com.

1.16 Your Right to Cancel Your Order (Right of Withdrawal)

  1. Subject to the terms set out below, you have the right to cancel your Order and return the goods up to three (3) business days starting from the day the goods are received by you, subjected to evaluation within three (3) days starting from the day we received your returned items, and provided that
    1. You have proof of purchase (order invoice number and receipt).
    2. You received undrinkable wine* (*subjected to evaluation within three (3) days starting from the day we received your returned items)
    3. You received the wrong item in your package.
    4. You received breakage of wines upon arrival.
    5. You received missing items in your package.
    6. Your product does not match the website specifications or description.
    7. If delivery has taken place, the refund will exclude delivery charges paid.
    8. One exchange is allowed per purchase. The exchange product will not be eligible for further exchange or refund unless faulty.
  2. Other than as set out in clause 1.16.1, Wine and Malt will generally not provide you with a refund or exchange simply because you changed your mind or the goods were not what you expected.

1.18 Force Majeure

Wine and Malt will not be liable for any delay in performing any of their obligations if such delay is caused by circumstances beyond their reasonable control, including but not limited to failure of or interruption in the provision of essential services such as electricity supply, bank payment systems or postal deliveries

1.19 Governing Law

The courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our website or any Order placed on the website, although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These Terms are governed by Singapore law.

1.20 Severability

If any part of these terms are found to be void, invalid, unlawful or unenforceable then that provision or part will be deemed to be severed from these terms and the remaining terms and provisions of these terms will remain in force and constitute the agreement between you and Wine and Malt.

1.21 Transfer and Assignment

If Wine and Malt merges, sells or otherwise changes control of its business or this website to a third-party, Wine and Malt reserves the right, without giving notice or seeking consent, to transfer or assign the personal information, content and rights that Wine and Malt has collected from you and any agreements it has made with you.

1.22 Waiver

The failure by Wine and Malt to exercise or enforce any right or provision under these terms will not constitute a waiver of such right or provision. Any waiver of any provision under these terms will only be effective if it is in writing and signed by Wine and Malt.

2.1 Returns

2.1.1 Does Wine and Malt accept returns?

  • We recommend you read our Returns Policy prior to making a purchase from our website, so that you are familiar with our policy on refunds, returns and your legal rights and remedies.
  • We also recommend you immediately inspect any goods that are delivered to you immediately upon receipt to ensure you are completely satisfied with the goods, including that the goods are of acceptable quality, and match the description we have provided to you. And shall notify us within 24 hours for any discrepancies or damage starting from the date you received the item to the time you fill out the Online Returns Form. We reserve the right to reject any return, exchange deemed unfit or unreasonable.

  • This Returns Policy only applies where you make a purchase online from our website.

2.1.2 What is the returns process?

Returns must be done within seven (7) working days starting from the day the goods are delivered to you. You may return your order (or items) for any of the following reasons:

  • Your product does not match the website specifications or description.
  • You received the wrong item in your package.
  • You received missing items in your package.
  • You received breakage of wines upon arrival.
  • You received undrinkable wine* (*subjected to evaluation within seven (7) days starting from the day we received your returned items)
  • And the general requirements for returns are as follows:
  • Return reason has to be valid and returns acceptance conditions met based on the return reasons mentioned above.
  • You have proof of purchase (order invoice number and receipt).
  • All wines returned should not be less than half bottle subjected to evaluation within seven (7) days starting from the day we received your returned items.
  • Under what conditions is/are the product non-returnable:
  • Undrinkable or spoilage wine due to misuse or inappropriate handling and storage of the products upon receipt.
  • Change of mind upon receipt.
  • If your return meets all the requirements above and you wish to proceed with the return, please have your order invoice number ready and contact our Admin at wineandmalt@gmail.com using the Contact Us Form here.
  • Our customer service agent will verify the return reason and arrange a free return pick-up for you.
  • Our courier company will pick up the package at the time specified by you.
  • We will conduct an evaluation within seven (7) days starting from the day we received your returned items. You will receive an email confirmation once the returned item is received from our end.

2.1.3 If your return is valid

we will process your replacement, based on what you have indicated to our Admin at admin@winenmalt.com. If it’s valid, our customer service agent will verify the return reason and arrange a free return pick-up for you.

2.1.4 If your return is not valid

we will notify you and arrange the items to be returned. For the items to be returned, a delivery fee will be chargeable. We reserve the right to reject any return, exchange, refund deemed unfit or unreasonable.

2.1.5 What if my product is damaged in transit?

If any goods are delivered to you are damaged, simply visit any of our retail stores or contact our Admin at admin@winenmalt.com within three (3) working days of receiving the delivery.We will arrange to have the damaged goods returned and either arrange for a replacement of the goods or refund the price to you. Damaged goods must be returned in the condition received by you with all original packaging, and/or accessories. We reserve the right to reject any return, exchange deemed unfit or unreasonable.

2.1.7 Does Wine and Malt cover the shipment cost for returns?

Yes. Returning an item with Wine and Malt is free of charge. Please contact our Admin at admin@winenmalt.com using the Contact Us Form here.

3.1 Refunds

3.1.1 How will I be refunded?

The refund will be made back to the same card you made the purchase with.

3.1.2 How long does it take for me to receive a refund?

Your returned items, together with your return slip, are usually received and accepted at our warehouse within 1-3 working days after the courier company picks up the package from you.

A refund would be issued shortly after we receive your items from the courier company, according to the preferred refund method indicated on your return slip.

Credit Card: up to fourteen (14) working days, subjected to processing duration of your local bank.

3.1.3 I have changed my mind and would like to cancel my order. Will I be refunded?

This is the Wine and Malt Personal Data Protection Policy (“Personal Data Protection Policy”) and the purpose of this document is to inform you of Wine and Malt manages, collects, uses and discloses your Personal Data, which is subject to the Singapore Personal Data Protection Act (2012) (“the Act”). This Privacy Policy outlines Wine and Malt’s policy and responsibility in relation to the collection, use and disclosure of Customer Data.

By continuing to use Wine and Malt’s services, you signify that you have read, understood and agree to be bound by this Privacy Policy as amended from time to time in respect of Wine and Malt’s collection, use and disclosure of your Customer Data. This Privacy Policy is divided into two Parts – A and B:

Part A: General Customer Data Privacy Policy Statement

  1. Types of Customer Data
    The types of Customer Data that Wine and Malt collects depend on the circumstances of collection and on the nature of the service requested or transaction undertaken. There are two broad categories of Customer Data that Wine and Malt collects:
    Personal Data, which includes but is not limited to -
    1. personal information that links back to an individual e.g., name gender, date of birth, NRIC or other personal identification numbers;
    2. contact information e.g., address, phone number, email address;
    3. technical information e.g., IP address; and

    Statistical Data e.g., number of visitors, to website. This is stored purely for analytical purposes, and is entirely anonymous. This information will not be stored to your customer record, and will only be aggregated for statistical analysis so that we can better understand Wine and Malt's customer profile and improve Wine and Malt's service offering.
    For purposes of this policy statement, the phrase Customer Data includes Personal Data and Statistical Data. The provision of Customer Data (save for where the request for data is marked “optional” in the forms used to collect personal data) is obligatory in order for Wine and Malt to carry out its services to you. The failure to supply such Customer Data may result in (i) Wine and Malt being unable to provide you with the services and/or products requested; (ii) Wine and Malt being unable to update you on our latest products and/or launches; and/or (iii) your inability to enter or participate in contests, promotions or redemption activities organised by Wine and Malt.

  2. Purposes for Collection, Use and Disclosure
    Generally, Wine and Malt collects Customer Data, either directly from you or from third parties (e.g. our service provider), or from publicly available sources, through our website, mobile services, and other channels including our retail outlets, in order to fulfil the following purposes, which include but are not limited to:
    Providing services to you such as processing a transaction (e.g., making an order online), providing technical or customer service assistance, assisting you in the transaction through Wine and Malt’s website;
    Marketing and communicating with you in relation to products and services offered by Wine and Malt, Wine and Malt’s service partners, as well as Wine and Malt’s appointed agents;
    Contacting you for product or customer satisfaction surveys and market research;
  3. Safety, security and legal compliance.
    Wine and Malt may also use and disclose your Customer Data with and to third parties in order to fulfil the purposes listed above. Wine and Malt shall use its best endeavours to ensure that its employees, officers, agents, consultants, contractors and such other third parties mentioned above who are involved in the collection, use and disclosure of Customer Data will observe and adhere to the terms of this Privacy Policy. Wine and Malt may disclose your Customer Data to law enforcement agencies and government for security, customs and immigration purposes.
    In addition, Wine and Malt may disclose Customer Data to our legal advisors for establishing, exercising or defending our legal rights, to our other professional advisors, or as otherwise authorised or required by law. Wine and Malt also reserves the right to share Customer Data as is necessary to prevent a threat to the life, health or security of an individual or corporate entity such as Wine and Malt. Further, Wine and Malt may disclose Customer Data, as is necessary, to investigate suspected unlawful activities including but not limited to fraud, intellectual property infringement or privacy.
  4. Transfer of Information Overseas
    The Wine and Malt Office is based in Singapore. Customer Data may be transmitted to data storage where Wine and Malt keeps its central records. Customer Data may be transferred to Wine and Malt’s offices and appointed agents in Singapore or other countries in connection with Wine and Malt’s performance of the contract with you.
  5. Consent 
    Generally, in the course of Wine and Malt performing transactional functions such as making an order online, Customer Data will, by nature of the task or transaction, be provided by our customers to Wine and Malt. In such instances, consent will necessarily be implied from the Customer that they are agreeable to providing Customer Data in order for Wine and Malt to provide the requested or necessary service and/or product to them. However, where required by law, Wine and Malt will adopt an ‘opt-in' policy for obtaining customer consent, in which event, express written consent will be sought from you when collecting your Customer Data e.g., signing a form or checking a box. Where you make reservations on behalf of another person, you undertake and will ensure that the individual whose Customer Data is supplied to Wine and Malt has authorized the disclosure, is informed of and consents to the terms and conditions of this Privacy Policy. You may submit a request to withdraw your consent at any time by contacting Wine and Malt (see Section 10). Statistical Data is not linked to a customer record and Wine and Malt does not need to seek consent for the collection, use or disclosure of Statistical Data. For more information on the collection and usage of Customer Data obtained from Wine and Malt’s websites facility, please refer to Part B.
  6. Access 
    Wine and Malt will, upon your written request to our Data Protection Department (see Section 10), allow you to view your stored Personal Data. Where permitted by law, Wine and Malt reserves the right to charge a reasonable administrative fee for this service. In exceptional circumstances, Wine and Malt reserves the right to deny you access to your Personal Data and may provide an explanation as required by applicable laws. Exceptional circumstances include where:
    An investigating authority or government institution objects to Wine and Malt complying with a customer’s request,
    The information may, in the exercise of Wine and Malt’s reasonable discretion and/or assessment, affect the life or security of an individual, and
    Data is collected in connection with an investigation of a breach of contract, suspicion of fraudulent activities or contravention of law.

  7. Retention
  8. Wine and Malt will retain Customer Data for as long as it is necessary to fulfil the purpose for which it was collected, the legal or business purposes of Wine and Malt, or as required by relevant laws. When destroying Customer Data, we will take commercially reasonable and technically possible measures to make the personal information irrecoverable or irreproducible in accordance with the applicable laws.
  9. Accuracy
    Wine and Malt needs your assistance to ensure that your Personal Data is current, complete and accurate. As such, please inform Wine and Malt of changes to your Personal Data by contacting Wine and Malt and submitting your updated particulars to Wine and Malt in writing (see Section 10).
    Wine and Malt may also request Personal Data updates from you from time to time. As detailed in Section 2 above under the “Purposes for Collection, Use and Disclosure” sub-section, your delivery address may be disclosed to the appropriate delivery fulfilment companies. As such, it is important to ensure that the Personal Data contained in your order confirmation is current, complete and accurate.
  10. Security Safeguards
    Wine and Malt takes the security and protection of your Customer Data very seriously. As such, Wine and Malt makes reasonable security arrangements to protect your Customer Data against loss or theft as well as unauthorised access and undue disclosure. Examples of technical safeguards include encryption, Network and Web Application Firewalls ,“firewalls” and Secure Socket Layer (SSL). Further details of these technical safeguards for Customer Data collected through Wine and Malt’s websites facility are set out at Part B below. If, however, a customer does not take reasonable care to ensure the continued confidentiality and accuracy of their Customer Data, Wine and Malt will not be liable for any consequential misuse and/or fraud. If you have any concerns about security, you should contact Wine and Malt (see Section 10).
  11. Updates to the Privacy Policy
    Wine and Malt will amend this Privacy Policy from time to time and the updated versions will be posted on Wine and Malt’s website and date stamped so that you are aware of when the Privacy Policy was last updated. Subject to applicable laws, the English version of this Privacy Policy will prevail over any version of this Privacy Policy in another language. In the event of any inconsistency in interpretation between the English version and any translation of the Privacy Policy, this Privacy Policy statement in English will prevail.

  1. Security Safeguards
    Wine and Malt takes the protection of your Customer Data collected on Wine and Malt’s websites very seriously. All Customer Data collected through Wine and Malt’s websites, e.g., http://www.winenmalt.com are protected by a secure server. In addition, SSL (Secure Socket Layer) protects the transmission of data from the internet to our systems. To further strengthen the integrity of your internet transactions on our websites, Wine and Malt also employs relevant software programs to monitor network traffic with a view to identifying unauthorised attempts to upload or change Customer Data, perpetuate fraudulent or illegal activities or otherwise cause damage. If such monitoring reveals evidence of possible abuse or criminal activities, such evidence may be provided to appropriate law enforcement authorities or agencies without notice to you. To give you secure access to our online services, arising from your utilisation of Wine and Malt’s website, you can register with us. You should not share your User ID or Password and should always ‘log off' once you have finished your session on the websites as well as take the recommended precautions that ensure the safe and secure provision of Wine and Malt’s website.

    Most websites like ours use cookies to enhance your online experience. Cookies are alphanumeric identifiers that are transferred to your computer's hard drive from your web browser to recognise your preferences and to tailor content to you. The cookies do not contain your Customer Data but only Statistical Data which is entirely anonymous.   3. Clickstream Data
    In order to improve your online experience, Wine and Malt may track online behaviour or clickstream data to advance your use of our web pages and track referrals from other websites. Such data will not be stored to your customer record, and will only be aggregated for statistical analysis.

Please note that the Wine and Malt Privacy Policy does not cover these other websites, and Wine and Malt would recommend that you are apprised of their specific policies.

    Wine and Malt cannot distinguish the age of persons who access and use its websites.
